Welcome to Weelp. By downloading, installing, or using the Weelp mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

⚠️ IMPORTANT DISCLAIMER - EMERGENCY SERVICES

Weelp is NOT an emergency service and does NOT dispatch emergency responders.

Weelp is an INFORMATIONAL and EDUCATIONAL application that:

Displays publicly available emergency phone numbers
Shows nearby medical facilities on a map
Provides educational first aid guides and safety tips

Weelp does NOT:

Contact emergency services on your behalf
Transmit your location to emergency responders
Dispatch ambulances, police, or fire services
Guarantee the accuracy or availability of emergency numbers displayed
Replace official emergency services (112, 911, etc.)

IN CASE OF EMERGENCY: You must contact official emergency services directly by dialing the local emergency number (112 in Europe, 911 in the US, 15/17/18 in France, etc.) or by going to the nearest emergency room.

By using this App, you acknowledge and accept that Weelp cannot be held responsible for any delay, error, or inability to reach emergency services.

1. Description of Service

Weelp is a global safety companion application that provides:

Access to local emergency phone numbers based on your location
Information about nearby medical facilities (hospitals, pharmacies, AEDs)
First aid guides and safety protocols
Medical profile and emergency contacts management
Country-specific safety information and travel tips
Pet safety information and emergency contacts

The App is designed for informational and educational purposes only.

2. Eligibility

You must be at least 16 years old to use Weelp. By using the App, you represent that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

3. Account Registration

To access certain features, you may need to create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

4.1 Free and Premium Access

The App offers limited free features
Premium features require a paid subscription (monthly, annual, or lifetime)

4.2 Payment Processing

All payments are processed through Apple App Store
We do not collect or store your payment information
Prices are displayed in your local currency and may vary by region

4.3 Subscription Terms

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
You can manage and cancel subscriptions in your Apple ID account settings
No refunds are provided for partial subscription periods

4.4 Free Trials

If offered, free trials automatically convert to paid subscriptions unless cancelled
You will be charged at the end of the trial period if not cancelled

5. Acceptable Use

You agree NOT to:

Use the App for any illegal purpose
Attempt to gain unauthorized access to the App or its systems
Interfere with or disrupt the App's functionality
Copy, modify, or distribute the App's content without permission
Use the App to harass, abuse, or harm others
Provide false or misleading information
Use the App in any way that could damage our reputation

6. Medical Information Disclaimer

6.1 Not Medical Advice

The health and first aid information provided in the App is for educational purposes only and does NOT constitute medical advice. Always consult a qualified healthcare professional for medical concerns.

6.2 Medical Profile

You are responsible for the accuracy of information in your medical profile
We are not responsible for any consequences resulting from inaccurate medical information
Your medical profile is stored locally on your device and optionally synced to secure cloud storage

6.3 First Aid Guides

First aid guides are provided for educational purposes
They do not replace professional medical training
In emergencies, always call professional emergency services first

7. Location Services

7.1 Purpose

We use your location to:

Display emergency numbers for your current country
Show nearby medical facilities and services
Provide location-relevant safety information

7.2 Limitations

Your location is NOT transmitted to emergency services
We do not track your location continuously
Location accuracy depends on your device and network conditions
We are not responsible for inaccuracies in location-based information

8. Intellectual Property

8.1 Ownership

All content, features, and functionality of the App are owned by Marieme Seck and are protected by international copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8.3 Restrictions

You may not:

Copy, modify, or create derivative works of the App
Reverse engineer or decompile the App
Remove any copyright or proprietary notices
Use our trademarks without written permission

9. User Content

9.1 Your Content

You retain ownership of content you create (medical profile, photos, notes). By using the App, you grant us a limited license to store and display your content as necessary to provide the service.

9.2 Responsibility

You are solely responsible for the content you create and store in the App.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy at https://www.weelp.app/privacy-policy-mobile to understand how we collect, use, and protect your information.

Key points:

Your contacts are NEVER uploaded to our servers
Your location is NOT transmitted to emergency services
Medical information is encrypted and stored securely

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

The App will be uninterrupted or error-free
Emergency numbers displayed are accurate or up-to-date
Medical facility information is complete or accurate
The App will meet your specific requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Weelp and Marieme Seck shall not be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
We are not liable for any failure to reach emergency services
We are not liable for any actions taken based on information provided in the App

13. Indemnification

You agree to indemnify and hold harmless Marieme Seck and Weelp from any claims, damages, losses, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights

14. Termination

14.1 By You

You may stop using the App at any time and delete your account through the App settings.

14.2 By Us

We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion.

14.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions that should survive termination will remain in effect.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Weelp regarding the use of the App.
